Yet today in New Hampshire and elsewhere in the United States, law enforcement officers can take an individual’s property without convicting the owner of a crime. Under this process, known as civil asset forfeiture, the burden is on the owner to prove that the assets are innocent in order to reclaim seized property. Critics have argued that civil asset forfeiture creates perverse incentives, since it is currently easier to seize property than it is to convict someone, and since proceeds from seizures often end up going directly into law enforcement budgets. Indeed, a recent study by the Institute for Justice gave New Hampshire a “D-” grade and called its civil forfeiture laws “a threat to property owners.” Between direct seizures by state agencies and revenue-sharing agreements with federal law enforcement, New Hampshire has taken nearly $19 million in civil forfeiture proceeds since 2000. Civil forfeiture is a law that allows police to take, keep, and profit from someone's property without even charging them with a crime—much less convicting them of one. Matt Miller, senior attorney for the Goldwater Institute, explains more about what this law is and how it is being used in America today. Police can use civil forfeiture to seize property that is merely suspected of involvement in criminal activity. Unlike criminal forfeiture, the government does not need to prove that a crime occurred. In Arizona, no one even has to be charged with a crime for their property to be confiscated. That makes it easy and lucrative for the government to take and keep property, regardless of whether the owner was guilty or innocent. It is such an effective tool that hundreds of millions of dollars are forfeited in just this way every year across America. Once the property is seized, it is up to the owner of the property to hire a lawyer and go to court to attempt to get his or her property back. No attorney is provided by the government, which means the property owner will need to spend thousands of dollars to even get into court. Furthermore, unlike in criminal cases, the government does not have to prove its case “beyond a reasonable doubt.” It must merely show by “clear and convincing” evidence that the property was being used in connection with a crime. (This standard was actually strengthened, from “preponderance of the evidence,” in 2017.) Innocent owners—whose property was used by someone else—face an additional hurdle. Arizona requires them to show that they “did not know, and could not reasonably have known” 7 that their property would be used in the commission of a crime. In other words, Arizona requires innocent owners to prove a negative, a notoriously challenging burden of proof in legal cases. Lead attorney Richard Nix thinks more than 100 people were probably impacted by the city’s program. All of the belongings and alleged drugs that were seized by police haven’t been located in the investigation. The totality of cash taken estimates $5,500. A state lawmaker, and the Missouri School Board Association say according to state law, that money should actually be going to schools. A KMBC 9 investigation into civil asset forfeiture in Kansas found law enforcement agencies across the state are also making millions of dollars every year, and that the Kansas Highway Patrol makes nearly all of its significant seizures from vehicles with out of state plates. In Kansas, authorities can forfeit money or property even if a person hasn’t been convicted of a crime. Missouri laws are stricter. They require a conviction before assets may be forfeited, and, unlike Kansas, the money seized doesn’t stay with law enforcement agencies. It goes to schools, or at least, that’s what the law says. Law enforcement agencies have found a way around that. Instead of handling cases locally, forfeiture cases are taken through the U.S. Attorney’s Office – federal court. Under federal law, law enforcement doesn’t need a conviction to seize assets, and law enforcement agencies get to keep what they take. Law enforcement agencies like the Kansas City Police Department say civil asset forfeiture is just another way to punish criminals. "We can immediately put that back in our toolbelt if you will,” said Major Derek McCollum, the head of KCPD’s Asset Forfeiture Squad. State auditor records show law enforcement agencies across Missouri seized more than $19 million in the past three years. Only $340,000 of that made its way to schools. That's less than 2 percent. Missouri State Representative Shamed Dogan (R – St. Louis) is working to pass a change to the law. “It means we’re not getting what we’ve expected,” Dogan said. “I think schools are frustrated with that.” State law directs any forfeited money to a building or repair fund for state schools, but law enforcement agencies like KCPD are spending it on themselves. "Computer type equipment, covert surveillance type equipment,” McCollum said of typical purchases. Cpt. McCollum said he doesn’t feel like law enforcement is taking money from schools. Susan Goldammer, an attorney for the Missouri School Board Association, feels differently. “Absolutely, the constitution says it is,” she said of the forfeiture money. "We still have school districts that don't have air conditioning, or have concerns about asbestos.” Last year alone, the Missouri Highway Patrol spent more than $70,000 of forfeiture money just on weapons. The Missouri law enforcement agency that benefits the most from civil asset forfeiture is the Phelps County Sheriff's Office in Rolla. The department spends most of that money to repair its own buildings, not schools, according to finance records. "We've got many, many school buildings in the state that are way more than 100 years old,” Goldammer said. In the new bill introduced by Rep. Dogan, only cases involving dollar amounts above $50,000 could be pushed to federal court. "By cooperating with the federal government, they better have a darn good reason for doing that,” Dogan said. Dogan says cases over $50,000 account for about 20 percent of the total number of forfeiture cases statewide. "We can eliminate that incentive for them to just take money or take property,” Dogan said. He believes smaller seizures are often from innocent victims, or involve rights violations. "The government seizes their money and says, ‘we think you're a suspected drug dealer’,” Dogan said. “The government never produces any drugs, never charges you with a crime and then you have to spend more than they've actually seized trying to get your property back. That's unfair." The Kansas City Police Department doesn’t see it that way. "We just work within the confines of the law that's currently on the books,” McCollum said. Dogan has tried the bill before with a $100,000 limit, but got push back from law enforcement. While he believes his bill would help stop rights violations, he says 80 percent of money from forfeiture comes from those 20 percent of cases above the $50,000 mark. Those cases could still go to the federal government, sending that money back to law enforcement under his bill. Both KCPD and the school board association said the bigger goal is to make sure both groups are fully funded. "It can make a huge difference, particularly in my smaller school districts,” Goldammer said. "There's a big pot of money out there,” McCollum said. “I think it warrants scrutiny." KCPD and MSBA do not have an official position on the bill yet. Terry saved up cash and kept it in his Pittsburgh home over many years. But when he moved out of his old house into a new, smaller apartment he didn’t feel safe keeping so much in cash savings. He asked his daughter, Rebecca Brown, to take the money home with her to Boston, deposit it into a new joint bank account, and use the money to replace his teeth and fix his truck, among other needs. https://ij.org/case/pittsburgh-forfeiture/ Concerned about flying with the more than $82,000 her father had entrusted to her, Rebecca checked online to make sure that she didn’t need to do anything to take the money with her on the plane. She found out that flying domestically with any amount of cash is completely legal. So, she packed the money in her carry-on and headed to the airport. But she didn’t make it to Boston with her father’s life savings. Her bag was held by the Transportation Security Administration (TSA) after she went through security screening because the money showed up on their X-ray. She was questioned by Pennsylvania State Troopers and then further by a Drug Enforcement Administration (DEA) agent. The DEA agent took the money without charging Rebecca with a crime or arresting her. After making them wait for months, the government told Terry and Rebecca that it wants to take that money for good using a legal process called civil forfeiture. Terry and Rebecca didn’t do anything wrong. That’s why they are teaming up with the Institute for Justice (IJ) to file a lawsuit to get the money back from DEA. Furthermore, their lawsuit is a class action against DEA and TSA for practices that violate the constitution and are outside TSA’s legal authority. Go to reason.com for a point of view you won't get from legacy media and old left-right opinion magazines. ____ When the White House hosted a meeting of sheriffs from across the country last February, President Donald Trump joked about destroying the career of a Texas state senator who supported reforms to civil asset forfeiture laws—a controversial practice where police can seize cash and property of people suspected—but in most cases never convicted or charged with a crime. Though Trump's comments were meant to support police, they've had the opposite of their intended impact—it's re-energized the push for reform. Texas state senator Konni Burton was one of many local lawmakers outraged by Trump's comments. She's a tea party leader from the Dallas-Fort Worth area who also happens to be pro-life and pro-borders. Burton isn't the unnamed state senator Trump offered to destroy, but she's emerged as the state's fiercest opponent of civil asset forfeiture. "When you give law enforcement the ability to take your property without a conviction that's big government," Burton says. Last December, Burton filed legislation that would repeal civil asset forfeiture in the state and replace it with criminal asset forfeiture. "Police can still seize property that they think has been involved in a crime," says Burton, "but for them to keep it … you have to be convicted of a crime." Texas has tried for years to reform civil asset forfeiture laws after horror stories began to emerge about the practice. One of the most horrifying cases occurred in 2005, when cops seized $10,000 from Javier Gonzales who was driving from Austin to the border town of Brownsville to make funeral arrangements for his dying aunt. The cops didn't find any drugs or contraband in his car, but they pressured Gonzales to sign away his rights to the cash under the threat of a felony money laundering charge. Gonzales took the case to court and eventually won his money back in April of 2008. And in 2012 the ACLU settled a class action lawsuit against the city of Tenaha where cops illegally seized nearly $3 million from traffic stops involving mostly Black and Latino drivers. Victims were told that they could either sign their cash over to the city or go to jail. Cases like this have earned Texas a D+ from the Institute for Justice for forfeiture laws. Data from the libertarian legal organization shows that the state takes in an average of $41.6 million dollars a year to local law enforcement agencies as a result of these seizures. Burton's bill has bipartisan support, but it faces an uphill battle in the Texas legislature where it's faced opposition from "tough on crime" lawmakers and law enforcement agencies. Burton says her legislation isn"t about stopping police from doing their job, but protecting the property rights of all Texans. "Everybody is ready for this to be reformed," Burton says. Readers noted that the story pointed out the person who owned the bag was not arrested. One person responded, “Is it illegal to have money?” Another person, whose response was retweeted more than 6,000 times, said that police can seize people’s money even if they are not charged with a crime. The answer? Yes, police in most states can seize your money even if you’re not charged with a crime. "The presumption of innocence that applies in every criminal case, which is mandated by the constitution, does not apply in the civil forfeiture arena," says Matthew Lee, a partner at the law firm Blank Rome in Philadelphia. Civil forfeiture is happening in towns and cites across the country and it is perfectly legal. "The defendant is a piece of property. It's not a person. And that is, that makes forfeiture really an unusual legal concept." says Lee. Civil forfeiture has been around for hundreds of years, but during the Reagan administration, laws were written to allow the federal government to seize property connected to drug criminals, according to Lee. "They wanted to be able to take away the tools of their trade. The tools that allowed drug kingpins to facilitate the massive trafficking of narcotics." States and local municipalities wrote their own forfeiture laws and today proceeds from the sale of seized property can be used by those agencies in the war on drugs. In Philadelphia, courtroom 478 is where the civil forfeiture process begins. It's where the prosecutor and the property owners first meet. Usually the property owner is not represented by a lawyer and because forfeiture is a civil proceeding and not criminal, there is no right to an attorney. "A layperson, with no training in the law has an extraordinarily difficult time navigating the courtroom 478 process, frankly many lawyers have a difficult time navigating that process." says Lee. Lee is also the president of the pro bono arm of the Philadelphia Bar Association, Philadelphia VIP, a clearinghouse that matches up lawyers with low income clients who need attorneys. If you receive a notice of civil forfeiture, Lee suggests the following: Don't ignore the initial paperwork. Show up at the place, date and time on the notice you receive. Find an attorney. Legal service organizations can help with what's called the innocent owner defense. "You have to prove, in a court of law that you were not involved in the underlying criminal activity and that you weren't aware of the underlying criminal activity," says Lee. He believes that if property owners were granted the right to an attorney, that it would level the playing field. "Because right now, the way the system works, it is, it is horribly out of balance and it weighted greatly in favor of the government." Civil asset forfeiture allows cops and federal agencies such as the FBI to seize cash and property of suspected criminals but it doesn't require them to bring any charges against their targets or even show that they were in any way involved with wrongdoing. In 2014, for instance, a Philadelphia couple had their house seized after police arrested their son for possessing $40 of heroin while living there. The parents weren't charged with any crime but in Pennsylvania and many other states, owners of seized property must prove their innocence to get their stuff back. Civil forfeiture creates terrible incentives for police. In many cases, the agency that seizes property and cash gets to keep a big chunk of it to fund purchases of equipment and pay personnel costs. In Mississippi in 2015, state narcotics officers alone seized $4 million in cash, cars—and even couches! In the Magnolia State, cops only get to keep 80 percent of the value of seized assets, but in 26 states, law enforcement gets to keep 100 percent of their haul, giving them an incentive to grab as much as possible, especially since it's time-consuming and expensive for defendants to go to court. Civil forfeiture is extremely unpopular. Although most states do their best to hide how much civil forfeiture goes on, it is an increasingly unpopular practice because it so obviously contravenes basic notions of justice. Even in deep-red states—such as Ohio, Utah, and Mississippi—polls routinely show massive majorities in favor of reform once voters understand just how unfair and non-transparent the process is. In fact, when President Trump threatened to "destroy" the career of a Texas state senator, he could have been referring to any of four politicians, three Republicans and a Democrat, who were deeply involved in reform efforts. That is exactly what happened to the Slatic family earlier this year, when the San Diego County District Attorney seized over $100,000 in personal bank accounts belonging to James Slatic, his wife Annette, and their two teenage daughters, Lily and Penny, without charging anyone with a crime. Police accused Med-West of operating a “clandestine” drug lab, even though the business complied with state medical marijuana laws, operated publically for two years, and paid its taxes. The police took everything from Med-West, including $324,000, and shut the business down. Then, a few days later, the District Attorney went after James’ family, seizing nearly every penny in their personal bank accounts. The seizure of the Slatic family’s money has nothing to do with crime fighting; it has everything to do with policing for profit. In the nine months since the raid, the District Attorney has not brought criminal charges against the Slatics or anyone associated with Med-West. The District Attorney has instead left the Slatics’ money in legal limbo, refusing even to begin legal proceedings in which the Slatics could prove their innocence. Now the Slatics have teamed up with the Institute for Justice to demand their money back. The District Attorney’s abuse of civil forfeiture takes the American principle of innocent until proven guilty and flips it on its head, treating innocent property owners like the Slatics worse than criminals. The SCRIPT: Imagine that you’re driving down the road. All of a sudden, you see flashing lights behind you, the telltale berries and cherries of a police officer. You aren’t sure what you did wrong, and your heart starts to pound in your chest. But you turn on your turn signal and pull over on the side of the road. Being a person of color, you start to feel incredibly nervous about having an encounter with the police. You never know when a situation might escalate into one of the deadly encounters you’ve seen over the news with what seems like increasing frequency. Your hands start to sweat and your heart rate increases as the officer approaches. The officer walks up to your window and raps on the glass. You lower the window and he asks you a few questions. You can’t really tell why exactly you were pulled over. The officer mentions the tint on your windows. He notices you’re nervous, and he gets suspicious. He continues to ask vague and confusing questions about where you’re going and why you’re using the road you’re on. Eventually, the smoking gun question gets issued by the officer: “Do you have any illegal substances in the vehicle?” “No!” You proclaim, innocently. The officer persists, requesting that he be allowed to search your vehicle. A K9 unit shows up and the dog alerts the officers to some illegal substances. Your head is dizzy because you didn’t think you had any drugs in the car. He asks you to exit the vehicle, and desperate to not escalate the confrontation, you comply. After all, you’re on your way home from your business, and you’re just trying to get home safely. The officer immediately handcuffs you and, having been given the tip from the dog, starts to search your vehicle. He finds .01 grams of marijuana, a microscopically small amount, and in the trunk, $17500 in cash. You try to explain to the officer that it’s meant to purchase supplies for your business, but it doesn’t matter. For the next two hours, you are detained, taken to a local police station, and have your money confiscated. In the end, you aren’t charged with any crime, but the police refuse to return your money to you. That $17500 that your business relied on is gone, potentially forever. You try to get it back, but what can you do? The officers have seized your money under civil asset forfeiture laws, and you’re unlikely to ever get it back. If this scenario sounds dystopian to you, you’re in for a sad awakening. This actually happened to Mandrel Stuart in Virginia in 2012. His restaurant, The Smoking Roosters, ended up going under because he couldn’t pay his bills, no doubt in part because of the financial hardship that was caused by the police’s actions. "It was like something you see in the movies. It was 6:30 in the morning, and basically you hear 'bang! bang! bang!' on the door, and next thing you know you hear the crash of a battering ram," says Oates. Oates' doctor had recommended medicinal marijuana for Oates' chronic back pain, so he attained a medical marijuana card with cultivation rights. Dispensaries were still few and far between at the time, and Oates didn't trust Craigslist for his medicine.MMJ Card "I felt like the next alternative was to grow it ourselves," says Oates. Oates met a few other patients who shared concerns about underground marijuana channels, and they decided to start growing together. Oates had their entire supply during the raid, which ended up being more than the permitted amount that he could grow with cultivation rights. He pled guilty to possessing under two pounds of marijuana. But the conviction ended up being the smallest price that Oates had to pay. Goodyear Police Department brought Oates' case to the Attorney General, who consequently slapped Oates with over $455,000 in civil asset forfeiture. Civil asset forfeiture is when the government can seize property and finances that they suspect have a connection to illicit activity. However, they sue the property instead of the person, so there doesn't have to be a related conviction. "That's what they're claiming, is that the market value of the sales that he allegedly made was $455,000," says Oates' attorney John Moore. "They don't have any proof or any evidence that the property that they are trying to forfeit is related to the crime of his possession of marijuana for sale." Oates says that between property taken, bank accounts seized, and legal fees, he has actually lost over $600,000, but that he would "rather spend every dollar on an attorney than just let [law enforcement] have it." Moore is helping Oates fight to get his assets back, yet says it's easier said than done. "In a typical civil case, it's the plaintiff that has the burden of proof. But in a civil forfeiture case, it turns­­ out it's actually the defendant that has to show where this money came from," says Moore. "We have to show by preponderance of the evidence, that this money that they are trying to forfeit came from legal means. Moore adds that Arizona has a direct incentive to utilize asset forfeiture because unlike other states, Arizona law enforcement gets to keep seized funds for their own departments. "Their focus is on raising revenues instead of actual law enforcement itself," says Moore. "Instead of going after real drug dealers who are transporting across state lines or criminal gangs that are creating great crime and personal injury to people, they're going after an individual because they know he had funds in his bank account." Most of the time where we see asset forfeiture, it's in relation to a traffic stop where law enforcement found large sums of money, say $5,000, $10,000, $100,000. So the easiest way to avoid asset forfeiture, under those circumstances, does not to travel with large sums of money. Now you're perfectly within your rights to do that, there's no reason why you can't have your money with you and transport it. There's no requirement that you use banks, but practically speaking, we've seen when law enforcement finds large sums of money during a traffic stop, they just take it and they assume that it's related to the drug trade and they filed to forfeit it so that it can go to the benefit of law enforcement and prosecutors in the operation of their duties, as opposed to you being able to keep that money. But, as subscribers of our YouTube channel know well, even innocent people aren’t safe from civil forfeiture. Stephen is a 39-year-old retired Marine from Lubbock, Texas. He is a devoted father of two teenage daughters and, once a month, he drives from Texas to see them in California, where they live with their mother. Eager to be closer after spending the pandemic in Texas caring for his elderly parents, he has been shopping for a home near the California-Nevada border. https://ij.org/case/nevada-civil-forfeiture/ In February 2021, Stephen was making his usual trip west through Reno when he was pulled over by the Nevada Highway Patrol for supposedly following a tractor-trailer too closely. The officer complimented Stephen’s driving, thanked him for observing the speed limit, and explained that NHP was “conducting a public information campaign” to help drivers avoid danger. Confident that the officer was only there to help, Stephen cooperated with his escalating investigation, even volunteering that he was carrying a large amount of cash. Ninety minutes later, Stephen had been robbed of his life savings—$86,900—which he carried with him after a spate of robberies in his parents’ neighborhood. The officer who pulled Stephen over wanted to let him go; he was overruled by NHP Sergeant Glenn Rigdon, who ordered the money seized specifically so that it could be “adopted” by the U.S. Drug Enforcement Administration. “Adoption” is a process by which federal law enforcement agencies can take over a seizure by state and local law enforcement. If the federal government is successful in forfeiting the property, its “equitable sharing” program guarantees the state or local agency that seized the property up to 80% of the proceeds for use in the agency’s budget. In Stephen’s case, the DEA sat on his life savings for months, ignoring the legal deadlines requiring it to charge Stephen with a crime, begin a civil forfeiture case against his property, or return the money within six months of seizure. The DEA did none of those things. So, on August 30, IJ sued it in federal court on Stephen’s behalf. Early the morning of September 1, the agency announced it would return all of Stephen’s money. In less than 24 hours, it had learned of our lawsuit, answered hard questions from The Washington Post, and committed to reviewing its policies for federal adoptions. When we learned he would be getting his money back (filled with joy), he told us, “This isn’t over.” And it isn’t. At the same time we filed in federal court, we also filed a major constitutional challenge in state court. Our state case aims to make federal adoptions impossible in Nevada as violations of the state constitution’s guarantees of reasonable seizures supported by probable cause and due process of law—not based on mere suspicion or for the financial benefit of the seizing agency. If we are successful, it will be the first time a state court has struck down federal adoptions. And a victory will take the profit motive out of roadside seizures. The most terrifying place in Philadelphia is Courtroom 478 in City Hall. This is where property owners enter Philadelphia’s Civil Forfeiture Machine. Philadelphia’s automated, machine-like forfeiture scheme is unprecedented in size. From 2002 to 2012, Philadelphia took in over $64 million in forfeiture funds—or almost $6 million per year. In 2011 alone, the city’s prosecutors filed 6,560 forfeiture petitions to take cash, cars, homes and other property. The Philadelphia District Attorney’s office used over $25 million of that $64 million to pay salaries, including the salaries of the very prosecutors who brought the forfeiture actions. This is almost twice as much as what all other Pennsylvania counties spent on salaries combined. This is how the city’s forfeiture machine works: Property owners who have their cash, cars or homes seized must go to Courtroom 478. But Courtroom 478 isn’t a courtroom at all: there is no judge or jury, just a scheduler and the prosecutors who run the show. Owners who ask for a lawyer are frequently told their case isn’t complicated and a lawyer isn’t necessary, but are then given a stack of complicated legal documents to fill out under oath. Time and time again, property owners must return to Courtroom 478—up to ten or more times in some cases. If they miss a single appearance, they can lose their property forever. Philadelphia’s forfeiture machine stacks the deck against property owners and leads city officials to police for profit instead of justice. To end these unconscionable and unconstitutional practices, the Institute for Justice and a group of property owners have brought a major, class-action lawsuit in federal court. "Why do we want to put them in that position?" Civil asset forfeiture is the process whereby police seize any property or money associated with a suspected crime, often drug-related. If the owner wants the seized property back, he or she must spend an often considerable amount of time and money to prove in court that the property wasn't used in the commission of a crime. As Jacob Sullum explained earlier this month, it's easy for innocent third parties to lose thousands of dollars in the process. In many states, the law permits police departments to auction off the seized assets and keep the cash. Critics say this system incentivizes "policing for profit" at the expense of innocent members of the community, while proponents argue that it motivates police officers to do their jobs better and funds police departments by "taxing criminals." Wilson, a professor of economics at Chapman University, and his co-author Michael Preciado designed a study to reveal how the incentives set forth under civil forfeiture affect human behavior. In the study, one undergraduate student plays the role of law enforcement in a computer game, and three others play the roles of the public. Subjects played for real money, and Wilson says the results were overwhelming. "It's not a few people just abusing it. This is the modal tendency: to abuse," says Wilson, who points out that subjects are more likely than not to help others in games when there's no financial cost of doing so. "For me, that's pretty strong evidence that it's the rules that are creating the incentives for them to police for profit." The DEA later seized the traveller's money, for added insult. The TSA employee, Lisa Farbstein, posted a picture of the suitcase containing the cash on her official TSA Twitter account at around 9 p.m. on June 30, and within 24 hours the online backlash had arrived with dozens of Twitter users calling out Farbstein for violating privacy, possibly exposing people to danger as she revealed the location the cash was found, as well as offering general condemnation that she posted a photo of another person's personal belongings online. According to an article in the Washington Post, it is not illegal to either carry on or check in a suitcase containing large amounts of cash on domestic U.S. flights. The same article noted, however, that the TSA recommends anyone carrying large amounts of cash to request a private screening. The TSA says their agents are trained to ask questions about large sums of money and if answers are not deemed satisfactory, the case can be turned over to airport police or other government agencies. In this case, the US$75,000 in cash was reportedly seized by the Drug Enforcement Administration under controversial 'civil forfeiture' laws that allow law enforcement to seize items, including cars, boats and houses, as well as cash, if law enforcement suspects the items or money was obtained by criminal means. Civil forfeiture laws are increasingly ensnaring individuals who claim they have no ties to crime, but who still had money or possessions taken from them by a government agency that is not required to prove anything in a court of law.
